Article 226-4 of the penal code stipulates that

“The act of entering the home of another using threats, assault or coercion, except in cases where the law allows it, is punishable by one year’s imprisonment and 15,000 fine euros.”

Urbex, which consists of exploring abandoned buildings or isolated places outside of any organized visit context, is not, at first glance, legal. However, the definition of “domicile” needs to be clarified. Indeed, if it is not a home, there is no offense.

Case law from the Court of Cassation recalled the definition of domicile: “The term domicile does not only designate the place where a person has his principal establishment, but also, as in this case, the place where, whether he lives there or not, he has the right to call himself home. , regardless of the legal title of its occupation and the use to which the premises are assigned.”

An uninhabited place, under French law, is therefore not necessarily a place which is not someone’s home, for example if the place is simply abandoned for a short period of time.

The concept is, however, quite vague and can be subject to interpretation in different cases. Thus, it is sometimes obvious that a place is abandoned, given its state of decrepitude. Sometimes it’s much harder to determine.

Then let’s return to intrusion. Intrusion is characterized if the introduction into the place can fall under one of the stated characterizations: “using maneuvers, threats, assault or coercion”. Here too, there is room for interpretation, but what is certain is that if the explorer enters without touching / moving / breaking anything, there is no violation. In reality, it does not take much for the violation to be characterized.

If there is “destruction, degradation or deterioration”, the penal code provides for two years’ imprisonment and a fine of 30,000 euros, “unless only slight damage results”. In the latter case, the penalty is a 3,750th fine and community service.

Finally, let’s talk about the photos and videos posted by an explorer and which end up on the internet. This content can be qualified as an invasion of privacy which is protected by article 9 of the Civil Code. This is for example the case of family photos filmed and broadcast in videos.

  • Have purchased individual coordinates (we do not refund the purchase of a map license, see why below).
  • Give us proof that the place(s) purchased have expired (In accordance with our T&Cs which you signed at the time of your purchase, we will not make any refunds or exchanges without proof).

After studying your request, we will respond to you as soon as possible (within 48 hours). We will discuss your request by email.

We do not refund the purchase of a map license unless you experience a technical problem (e.g. no access).

For what? Certain obsolete contact details do not constitute a valid reason for refounding (see our T&Cs). The price of the maps is much lower than the price of the coordinates if you buy them one by one, to take into account the likelihood that you may come across an outdated spot in your exploration.
